Panel 1:  FERC Guiding the Evolution of Energy Regulation:  EPAct 2005 gave FERC additional responsibilities regarding its regulation and oversight of the energy industries.  This panel will provide an overview of the industries that are regulated by FERC and the statutes establishing such authority.  Additionally, this panel will address how EPAct 2005 has changed FERC’s regulation over energy industries.  Finally, this panel will address FERC’s top priorities in implementing its additional responsibilities under EPAct 2005, particularly the primary industry-related issues that are pending before or being implemented by FERC.  Panelists: Cynthia A. Panel 2:  A Case Study Illustrating the FERC Process:  FERC regulates the energy industries through various regulatory and adjudicatory processes.  Through its rulemaking process, FERC creates regulations that are applicable industry-wide.  Individual players in the industries may also initiate action in FERC by submitting proposed revisions to rates, terms and conditions of service; filing a complaint alleging violations with FERC statutes or orders; or submitting applications for a license to build and operate a hydroelectric plant, or a permit or certificate for a new pipeline.  This panel will illustrate the various processes by which FERC regulates the energy industries in light of the specific interests and objectives of a fictitious company.  The panel will also highlight the changes in the processes due to EPAct 2005, as well as, illustrate the effective use of the resources at FERC to facilitate the FERC practice.  Finally, this panel will address FERC’s enforcement and investigatory authority to ensure compliance with its rules and regulations.  Panelists:  Jamie Simler, Kenneth G.
